**SECONDARY NOTICE POSTED 7/15/2019
Dear Valued Patient:
I am writing to you with important information about a potential recent breach of your protected health information (“PHI”). Clear Dermatology & Aesthetics Center and Investigate MD have investigated this breach, and our investigation revealed the following:
On May 2, 2019, Clear Dermatology & Aesthetics Center and Investigate MD (hereinafter referred to as “Clear Dermatology”) were burglarized at 6:40 PM. The burglar passed two levels of security to gain access to Clear Dermatology after the office was locked for the evening. Our investigation revealed that the burglar stole three research cameras, a flash ring, a laptop, and an iPad. At the time of the burglary, the stolen devices were stored in a locked office within Clear Dermatology. The devices were password protected.
Some of the stolen devices contain patient PHI including patient names, patient addresses, and patient test results. The stolen research cameras contain full-facial images of patients but do not contain any patient names or other patient information connected with the full-facial images. We do not believe that any patient billing information is stored on any of the stolen devices. We are working with law enforcement to investigate the theft and the perpetrator has been identified.
In light of this event, we advise that you take the following steps to protect yourself from potential harm resulting from the breach:
- Although no sensitive personal information was disclosed, you should be aware of phishing scams. It is possible that unscrupulous third parties may claim to provide notification and breach assistance, when in actuality the communication is a scam to obtain additional PHI. We also suggest you watch for any bills for services you did not receive.
- You may also contact the Federal Trade Commission at 1-877-382-4357 or at 600 Pennsylvania Ave., NW Washington, DC 20580 or visit the Federal Trade Commission’s website at www.identitytheft.gov if you are concerned about any misuse of your PHI.
Clear Dermatology has safeguards in place to ensure the privacy and security of patients’ PHI. As a result of this breach, we are taking immediate steps to further improve security of the Clear Dermatology offices and reduce future risk of theft. Immediately following the event, Clear Dermatology installed an ADT Security System and has added additional deadbolt locks throughout the office.
We apologize for any concerns this situation may have caused you, and we stand ready to support and assist you in addressing and resolving any problems you may confront as a result of this matter.
